Kinetriq Terms of Use

These Terms of Use ("Terms") govern your use of the Kinetriq iOS application and
related services (the "App"). By downloading or using the App, you agree to these
Terms. If you do not agree, do not use the App.

## 1. Health & fitness disclaimer (please read)

Kinetriq provides **general fitness and educational information only**. It is
**not medical advice**, is **not a medical device**, and is not intended to
diagnose, treat, cure, or prevent any condition or injury.

- Consult a qualified healthcare professional before beginning any exercise
  program, especially if you have an injury or medical condition.
- Movement analysis, scores, grades, and coaching cues are estimates produced by
  on-device AI and may be inaccurate. Use your own judgment.
- **Stop exercising and seek medical attention if you experience pain, dizziness,
  or discomfort.** You use the App and perform any exercises at your own risk.

## 2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your
jurisdiction) to use the App. By using the App, you represent that you meet this
requirement.

## 3. Your account

You are responsible for maintaining the confidentiality of your account
credentials and for all activity under your account. Provide accurate
information and keep it up to date. You may delete your account at any time in
Settings → Account.

## 4. Subscriptions, billing, and trials (Kinetriq Pro)

The App offers an auto-renewing subscription, **Kinetriq Pro**, with monthly and
annual options.

- **Billing:** Subscriptions are purchased through your Apple ID and billed via
  the App Store. Prices are shown in the App and may vary by region.
- **Free trial / introductory offer:** Where offered (e.g. a free first week),
  any unused portion of a free trial is forfeited when you purchase a
  subscription, where applicable.
- **Auto-renewal:** Your subscription automatically renews unless you cancel at
  least 24 hours before the end of the current period. Your Apple ID is charged
  for renewal within 24 hours before the period ends.
- **Managing/canceling:** Manage or cancel anytime in your Apple ID settings
  (Settings → your name → Subscriptions). Deleting the App does not cancel a
  subscription.
- **Refunds:** Purchases are handled by Apple; refunds are subject to Apple's
  policies. Contact Apple Support for refund requests.
- **Promo/comp codes:** Promotional or complimentary access may be offered at our
  discretion and may be changed or revoked if misused.

## 5. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to
use the App for your own non-commercial use, subject to these Terms and Apple's
terms. You agree not to:

- copy, modify, reverse engineer, or create derivative works of the App except
  as permitted by law;
- use the App to violate any law or infringe anyone's rights;
- interfere with or disrupt the App or its providers' systems; or
- attempt to gain unauthorized access to any part of the service.

## 6. Your content

Videos you capture or select are processed on your device. You retain all rights
to your content. If you share an exported clip or summary, you are responsible
for that content and for having the right to share it.

## 7. Intellectual property

The App, including its software, design, text, and branding ("Kinetriq" and
related marks), is owned by us or our licensors and is protected by intellectual
property laws. These Terms do not grant you any rights to our trademarks.

## 8. Third-party services

The App relies on third-party services (including Apple, Supabase, and
RevenueCat). Your use of those services may be subject to their terms and
policies. We are not responsible for third-party services.

## 9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,
WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO
NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

## 10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF
PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR
TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF
THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not
apply to you.

## 11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your
misuse of the App or violation of these Terms, to the extent permitted by law.

## 12. Termination

We may suspend or terminate your access if you violate these Terms. You may stop
using the App at any time and delete your account.

## 13. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated"
date and, where appropriate, notify you in the App. Continued use after changes
means you accept the updated Terms.

## 14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its
conflict-of-laws rules, except where applicable consumer-protection law requires
otherwise.

## 15. Apple-required terms

You acknowledge that these Terms are between you and us, not Apple, and that
Apple is not responsible for the App or its content. Apple and its subsidiaries
are third-party beneficiaries of these Terms and may enforce them against you.
Maintenance, support, warranty, and product-liability obligations (to the extent
not disclaimed) are ours, not Apple's.
